Is Burning the American flag legal in the United States?
The Supreme Court has ruled that flag burning is a form of symbolic speech protected under the First Amendment. This protection prevents the government from punishing flag burning to protect national symbols, according to the United States Courts.
Key rulings and details regarding flag burning:
In the landmark case Texas v. Johnson (1989), the Court held that desecrating the flag as a form of protest is expressive conduct safeguarded by the Constitution. This ruling invalidated prohibitions on flag desecration in most states.
Following Texas v. Johnson, Congress passed the Flag Protection Act of 1989, making flag desecration a federal crime. The Supreme Court struck down this law in United States v. Eichman (1990), reaffirming that flag burning is a protected form of free speech.
While constitutionally protected as speech, the act should not pose a danger to others or destroy private property.
Interestingly, the U.S. Flag Code itself suggests that a flag no longer fit for display should be destroyed in a dignified way, preferably by burning, although this is guidance, not a legal requirement with penalties.
